The NJ Division of Consumer Affairs, requires that all L/CADCs complete a 3-hour continuing education course in Legal Standards pertaining to alcohol and drug counseling in the State of NJ. This mandate is effective August of 2018 for the 2022 renewal period and biennially thereafter. This course will satisfy the requirement according to N.J.A.C. 13:34C-5.2(d). Course begins with an overview of changes in laws and regulations for NJ L/CADCs including the Uniform Enforcement Act and continuing education. In addition, participants will review regulations related to telehealth and clinical supervision. The course will also address clinical areas of practice such as informed consent, confidentiality and duty to report.

Upon completion of this course, participants will be able to:
• Distinguish between statutes and regulations that inform the scope of practice for L/CADCs.
• Discuss the NJ Uniform Enforcement Act
• Outline Duty to Warn, Protect and Report statutes in NJ
• Summarize telehealth regulations in NJ
• Discuss updates in clinical supervision

Ana Guerra, LCSW, LPC, LCADC, CCS
Ms. Guerra, is a seasoned mental health professional with extensive experience in mental health and substance use disorders. She specializes in the treatment of Co-Occurring Disorders and Trauma. Ms. Guerra parlayed her clinical experience into a career as an adjunct/faculty member for various colleges and universities in NJ. She proposed, developed the curriculum and taught the Substance Use Disorder courses at Kean University’s Social Work Department. Ms. Guerra teaches across the Bachelor and Master level curriculum in Social Work and Addiction Studies which includes courses such as “Trauma” and “Psychopathology”. Ms. Guerra is approved by the Addiction Professionals Certification Board of NJ to teach initial and re-certification L/CADC courses. As a trainer for New Jersey Prevention Network, she served as an integral team member revising the CADC curriculum. Ms. Guerra facilitates training and consultation for various mental health, substance use and academic settings. She maintains a private practice and is also a Clinical Supervisor for a residential and outpatient treatment facility. In 2019, Ms. Guerra was selected by the Council on Social Work Education (CSWE) to participate in the development of the CSWE’s Substance Use Curricular Guide which was published in 2020. In 2021, Ms. Guerra was approved by the Addiction Professionals Certification Board of NJ as a Mandatory Legal Class Trainer. In 2022, the NJ Alcohol and Drug Counselor Committee approved Ms. Guerra to teach the 3-hour Legal Standards course.

This course “Mandatory Renewal Legal Standards” provided by Behavioral Health Matters has been approved by the NJ Alcohol and Drug Counselor Committee.  This course is also approved for 3 continuing education credit hours by the APCBNJ, approval #403031424MandLegalREC3. Credentials issued by the APCBNJ, the NJ Board of Marriage and Family Therapy Examiners and the NJ Board of Social Work Examiners recognize such courses.  This 3 CE course is approved for social work continuing education hours in accordance with N.J.A.C. 13:44G-6.
